Ayodhya beyond judicial resolution.
The Allahabad High Court’s verdict on the Ayodhya title suits will hardly resolve the dispute. That is a task to be accomplished outside the courts, through political practice.
Political parties must accept this responsibility and conduct themselves accordingly. To say the Republic’s institutional integrity is supreme is one thing, but for the courts to be able to modulate societal behaviour to the constitutional norm is something else altogether.
Suppose the high court rules that the Waqf board is the rightful owner of the property on which the Babri mosque stood before its demolition in December 1992.
Will that make Hindu groups, especially members of the Sangh Parivar, the group of organisations ideologically and tactically guided by the Rashtriya Swayamsevak Sangh, reconcile themselves to not building a temple at what they believe to be the birthplace of Ram?
Will the Waqf board be right to remove the idols of Ram being worshipped at a makeshift shrine built at the site where the mosque once stood?
If, on the other hand, the court upholds a pro-temple title claim, would that mean that Muslims should recognise the entire movement to demolish the mosque, launched in 1982, complete with its blood spoor of hatred and violence, as legitimate?
Whichever side loses the case on Thursday is bound to go on appeal to the Supreme Court. That would only push back the day of reckoning, not make the questions disappear.
The obvious answer to these questions shows the majesty of the law rests, ultimately, on the will of the people, in whose name laws are enacted and upheld.
The will of the people is articulated by political parties. They must behave with responsibility.
The Congress would want no strife in the wake of the court verdict. The BJP, too, would want to avoid an immediate backlash that could see off their valuable ally in Bihar, but that would not restrain its allies in the Parivar.
Mulayam and Lalu would want to play aggressive champions of Muslims; so might Mayawati. Muslims should resist such patronage and focus on strengthening democracy, the sole guarantor of minority rights.
