2010, not 1984

MHA directive authoritarian.

Murderous Maoist violence must be put down. India must prevail over Maoism, as a democracy that counters and overcomes an anti-democratic force. This project would fail if the government turns authoritarian en route.

In this light, the home ministry’s press release issued last Thursday is alarming. Titled ‘Government asks people to be vigilant of CPI (Maoist) propaganda' it basically is a warning to activists, rights groups, NGOs and the intelligentsia to toe the government’s line on Maoists or be prepared for gaol.

This simply is not acceptable. The ministry’s logic is that Maoists contact some intellectuals and NGOs to propagate their ideology, and thus they could be slapped with section 39 of the Unlawful Activities (Prevention) Act (UAPA), 1967, which can mean a 10-year prison sentence. In effect, this is a direct assault on political discussion, debate, dissent and even freedom of the press.
    
The home ministry seems to have forgotten that democracy is as much about these things as it is about elections. There is a deliberate attempt to conflate opposition to or critique of the government’s strategy and actual support for Maoists.

Extreme left-wing political views exist, as do extremist-communal ones. Only when individuals or groups with such views deliberately aid, abet, or commit an illegal act can the law be invoked.

But the home ministry has gone beyond even that debate. With such a view of unlawful activities, not just being a critic of policy, but even possessing certain types of legal and available literature could be deemed illegal, as could even a journalist contacting a source.

The Karnataka police is, for instance, threatening to use the UAPA against a local journalist unless he provides information on his source for a story on Naxalism.

The other issue here is the common conflation between Maoists and Naxalites, who include political parties or trade unions working within the democratic framework, and are often targeted by Maoists. The government’s anti-Maoist drive clamps down on them, too, eroding democracy further.

  • I fully endorse the actions of MHA, as Maoists are taking the law into their hands and are pepetrating attrocities on innocent people and are causing unaccounted loss to the exchequer by destroying the public properties, which has to be termed as most heinous crime. If Maoists are having any ideology, they should eschew violence at once and believe in democratic process. Their attrocities should not go unabated any longer, failing which they should be meted out severest punishment and they should be made known that Govt. can no longer remain a silent spectator.

  • It will be difficult to give an impartial opinion on the Maoists assaults.In any violence ,organised or politically orchstrated against the estabishment, the innocent people are the victims. Because the incidence is treated as a law and order problem. But the quintessential quesition is has the government's apprehneinsion the Maoists movement could get public support, hence heavy hand of law should taccle it begs reason. What has been the impact of such steps in curbing the violece in the last 40 or 50 years. It has only aggravated the situaton.   • I think our Home Min. ruled like a britishers who had committed assault on political discussion, debate, dissent and even freedom of the press. I am very much surprised that we have caste our vote in his favour and elect him who is now belive in dictatorship.

  • Yes dictatorship is absolutely the only way to Deal with Maoist ,but keeping the safegaurd of innocent people. Oterwise another situation like Kashmir will crop up ,Human Right Commission and Amnesty should also keep in mind the way CRPF Personnel were laynched in Dantewada while reaching any conclusion since eradication is needed and a Libreral attitude should kept for Military operation

  • Obviously the Government does not anticipate any resistance from the BJP the main opposition party as that party also stands to benefit from the MHA order. This is nothing but Fascism in the garb of democracy. All national intellectuals in India would want a standard of life that is respectable for a human being given to the more than fifty percent of India's citizens. When the Government fails to show even a modicum of interest in that area many intellectuals voice theiir opinion in this regard. Or when the Maoists argue that they do not consider India's series of governments whether Congress, NDA or UPA as truly democratc what mostly they meant was the promises of health, prosperity and peace at 100% population level promised in the Indian Constitution were not even attempted more ...See More
